According to the Eiffel Tower's own website, professionals can take photographs and even film at the top of the tower — with proper authorization and fees, of course, because both the lights and the very image of the tower itself are copyrighted.
Francophiles know that for Sandler, Aniston, and their crew, filming at the top of the Eiffel Tower at night was probably pretty spectacular thanks to views of the city, even though the famous evening light show would have been over by the time they made it up there.
